Moapa Valley Justice Court Report (April 25, 2012)
Criminal court was held on Wednesday, April 18, 2012 with Judge Lanny Waite presiding.
Defendant: Stacey Stevens- Charges: Maintain place to sell controlled substance, Allow child to be present when Uniform Controlled Substance Act (UCSA) violated. Defendant appeared in custody and explained that she had been living with her husband, Joseph Gonzalez, in the residence in question. Defense counsel asked that defendant be released on her own recognizance. Standard bail was imposed and preliminary hearing set for May 9.
Defendant: Joseph Gonzalez- Charges: Maintain place to sell controlled substance, Allowing child to be present where UCSA violated, Conspiracy to violate UCSA, Two Counts of Trafficking in Controlled Substance. Imposed standard bail and set preliminary hearing for May 9.
Defendant: Brenda Hudson- Charges: Petit Larceny. Defendant appeared in custody. Had been sentenced in December to 25 hours of community service and $350 restitution paid to Lin’s. Had not paid restitution by 2/23. Case was then continued to 3/22 with a warning that restitution must be paid by then. Defendant failed to appear on 3/22 and a bench warrant was issued. Defendant was arrested and had served the last two days in CCDC. Defendant released on own recognizance and matter continued to 6/13 with warning that restitution must be paid by then.
Defendant: Josh Lewis- Charges: Battery/Domestic violence. Defendant appeared in custody. Defendant stated alleged victim was his father. Defendant was released on his own recognizance with the stipulation that he was to have no contact with the alleged victim. Trial was set for June 13.
Defendant: Joelann Costa- Charges: Petit Larceny. Defendant plead guilty to the charge. Sentenced to 25 hours community service and $350 in restitution to Lin’s Market. The matter was continued to July 11.
Defendant: Aaron Davidson- Charges: Battery/Domestic Violence, 2 counts. Not guilty plea entered on behalf of defendant. Trial set for June 13.
Defendant: Jacob Huerta- Charges: Battery/Domestic Violence. Arrested on charges involving girlfriend as alleged victim. Set trial for June 13 and instructed no contact with alleged victim.
Defendant: Jesus Santos- Charges: Assault with a deadly weapon, Battery/Domestic Violence. Matter was to be heard for trial. DA explained that they were unable to locate the alleged victim. Subpoena had been returned and phone calls had not be returned. Case was dismissed without prejudice. State may continue to proceed if warranted.
Defendant: Kurtis Taylor- Charges: Aiding minor to procure alcohol. Public defendant appointed to represent. State offered stay adjudication. Defendant would turn himself over to detention center in Mesquite for four days detention, self paid. The 30 day jail sentence would be suspended for two years during which time defendant would stay out of trouble, complete 100 hours of community service, complete a 12 step program for alcoholism and complete a certificate for diesel mechanic school in which he had enrolled and was scheduled to start next week. Defendant accepted state’s offer pleading no contest to the charges. Matter set for status check on July 11 by which time community service should be completed, and 12 step program and diesel mechanic school in progress.
Defendant: James Reilly- Status check on 2/2011 charges of Driving on Suspended License and Unlawful Possession of Drug Paraphernalia. Defendant not in attendance. It was reported that defendant has apparently not stayed out of trouble. He had been cited for Open Container, driving with no proof of insurance and driving on suspended license. Bench warrant issued, $5000 cash only.
Defendant: Corey Shawn Rowley- Charges: DUI/Drugs, Drive on suspended/revoked license, drive on right half of roadway. Matter was to be heard for trial. State’s chief witness, NHP officer, had been subpoenaed but was not present. It was the second scheduled appearance to which the officer had been absent. Case was dismissed.
Defendant: Randall Russell- Charges: Possession of Drug Paraphernalia. Appointed public defender to represent. Set trial for June 13.
