Justice Court Report (May 23, 2012)

Criminal court was held on Wednesday, May 16, 2012 with Judge Lanny Waite presiding.

Defendant: Stacey Stevens- Charges: Maintain place to sell controlled substance, Allow child to be present when Uniform Controlled Substance Act (UCSA) violated. Defendant’s counsel requested a continuance for the case. Set continuance for 6/13/12.

Defendant: Scott Robison- Issues arising from 2010 charge of Possession of Methamphetamine: Defendant appeared in custody. Had been on probation from charges originally filed in Sept 2010. Conditions had included defendant being subject to random drug testing within 2 hours of court contact. Court had tried to contact defendant a number of times to impose drug testing but was unable to make contact. Bench warrant was issued and defendant taken into custody on 5/13. Defendant’s counsel stated that the defendant had met all other conditions of probation and asked he be released from custody. Judge released defendant with the warning that he must be available for future random drug testing within two hours of request or be required to serve the 6 month jail sentence that is currently suspended in the case.

Defendant: Greg Cooley- Charges: Petit Larceny. Defendant plead guilty. Sentenced to $350 fines and $300 restitution. Also required to attend impulse control counseling, stay out of trouble for a year and subject to random drug testing. Given two months to pay fine or complete community service in lieu of fines.

Defendant: Lori Chavez- Charges: Petit Larceny. Defendant stated that she had no attorney. She was asked if she needed assistance from the Public Defender but declined stating that she would hire her own counsel. Trial date set for 7/11/2012.

Defendant: Sean Grayman- Charges: Burglary. Defendant plead guilty to charge of Petit Larceny. Defendant admitted to stealing a $9.99 pair of sunglasses from Lin’s Market. Court accepted the plea and sentenced $309 in retribution, 20 hours of community service and 30 days in jail suspended if stays out of trouble. Continued to 7/11/12 for status check.

Defendant: Joseph Russell- Charges: Battery/Domestic Violence. The DA had subpoenaed alleged victim as witness in the matter, but witness did not show up in court. Asked for continuance. Judge granted continuance and set trial for 8/8/12. Judge warned defendant to avoid contact with alleged victim regarding the case. Also warned that if alleged victim fails to appear in accordance with subpoena, could be held in contempt.

Defendant: Levi Kerbs- Charges: Battery/Domestic Violence. DA moved for dismissal since witnesses had not been served with subpoenas by the DA’s office. Judge dismissed the case with a warning to the defendent to stay away from the alleged victim.

Defendant: Adam Burr-Charges: Burglary-Auto. Status check: had completed community service and impulse control counseling. No proof of attendance of Narcotics Anonymous classes. Defendant not in attendance. Continued to 6/13/12 for final status check if all conditions met.

Defendant: Richard Gregory- Charges: Burglary, Grand Larceny. Status check: defendant had been sentenced to $1200 in restitution, still unpaid. Had previously issued bench warrant last Sept. and defendant was arrested. At that time defendant had promised to pay and was released on own recognizance. The balance was still unpaid. Judge issued a bench warrant, $1500 cash only.

Defendant: Kelley Gross- Status check on 2/2011 charges of DUI/Alcohol. Defendant had met all of conditions of earlier charges. But had been required to stay out of trouble. In February had been charged with driving without valid drivers license and DUI/drugs. Defendant stated he was not guilty of the new offense. Judge reminded that stay out of trouble condition was not ‘no convictions’ but ‘no arrests’. Judge stated the only reason defendant was not being put in jail was because he had met all the other conditions. Judge advised that if DA files on the new DUI case, he may revisit the matter. Set final status check for 8/8/2012.

Defendant: Harrison Navaho- Status check on 3/2011 DUI/Alcohol charges: Defendant had completed all conditions except $1010 in fines still unpaid. Judge advised that could be met with community service. Continued matter to 6/13/12. As long as fines paid by then, defendant need not return for the status check.

Defendant: Joseph Gonzalez- Charges: Maintain place to sell controlled substance, Allowing child to be present where UCSA violated, Conspiracy to violate UCSA, Two Counts of Trafficking in Controlled Substance. Bound over to District Court. Defendant will enter a plea of amended charges: attempt to possession of controlled substance; conspiracy to possession of drugs not to be introduced into interstate commerce.

Defendant: Gerald Morrill-Charges: Conspiracy to violate Uniform Controlled Substances Act, Trafficking in Controlled Substances. Defendant appeared in custody. Plead guilty to one count of possession of controlled substance not to be introduced into interstate commerce. Given credit for time served. Released.

Defendant: Laurie Ellen Paschal aka Axe- Charges: DUI/Drugs. Defendant plead not guilty. Set for trial on 6/13/2012.

Defendant: William Washam- Charges: Battery/domestic violence. Defendant plead not guilty. Set for trial on 7/11/12.

Defendant: Caleb Paice- Charges: Theft Misdemeanor. Defendant plead not guilty. Set for trial on 6/13/12.

Defendant: Benino Ramos- Charges: Theft Misdemeanor. Defendant plead not guilty. Set for trial on 6/13/12.

Defendant: Rephenelda Levi- Charges: Petit Larceny. Plead guilty. Sentenced to pay fine, restitution and stay out of trouble for one year. Continued to 7/11/12 status check.

Defendant: Gregory Wyatt Stites- Charges: Possession of Controlled Substance. Defendant appeared in custody. Had been on probation in District Court for previous drug-related charges. Plead guilty to possession charge. Case in District Court will go on as felony. Remanded to custody until heard in district court.

Defendant: Jeremy Cooper- Charges: Possession of Dangerous Weapon. Plead guilty. Had altercation with co-defendant Gregory Wyatt Stites where drugs were present. Sentenced to forfeit weapon, 30 hours community service, stay out of trouble for one year and no contact with co-defendant. 30 days suspended jail time. If meets conditions charges will be amended to disorderly conduct.
