Justice Court Report (July 18, 2012)
Moapa Valley Justice Court
Criminal court was held on Wednesday, July 11, 2012 with Judge Lanny Waite presiding.
Defendant: Daniel Cortez- Charges: Battery/Domestic Violence. Defense counsel informed the court that the defendant had relocated to Indiana permanently. Because of long history of problems in the community, the defendant and his family hoped that the proceedings in this matter could take place without the defendant returning. Judge Waite agreed that it would be best that the defendant remain out of the community. Expressed a hope that the defense attorney could work something out with the DA that the sentence could be carried out from a distance. Set a trial date for 9/5/2012.
Defendant: Benny Ramos- Charges: Theft: Defendant plead no contest to Disorderly Conduct. Sentenced to $350 fine plus 90 day jail sentence suspended for one year if stays out of trouble. Defendant will be subject to random substance abuse testing. Continued to 8/8/2012 for status check.
Defendant: Jesus Ramos- Charges: Possession of Drug Paraphernalia. Defendant entered a guilty plea. Sentenced to 6 month suspended jail sentence to stay out of trouble. Also to pay $500 fine and random drug testing. Case continued to 9/5/2012 for status check.
Defendant: Shaylnn Mallon Charges: Trespass. Contribute to Delinquency of Minor. Defendant was not present for proceedings. Bench warrant was issued.
Defendant: Robert Park- Charges: Abuse of Elderly Person and 2 counts Domestic Violence. Defendant plead guilty to counts. Expressed remorse for abusing father-in-law and shoving his wife during an altercation. Stated that he had been depressed and out of work and felt he had a breakdown. Sentenced to six months of weekly domestic violence counseling. Also a $470 fine. Gave 60 days suspended jail time to stay out of trouble for one year. Defendant had turned himself in and served 2 weeks in jail. Was given credit for time served. Status check set for 9/5/2012.
Defendant: Brenda Hudson- Charges: Petit Larceny, Burglary, Battery/Domestic violence. Not present. Public defender had no good contact information for defendant. Bench warrant issued.
Defendant: Lorrie Chavez- Charges: Petit Larceny. Defendant not present for proceedings. Had refused public defender appointment in previous court session saying that she would be hiring her own counsel. Bench warrant was issued and witness fee was charged.
Defendant: William Washum-Charges: Battery/Domestic Violence. Defendant plead No Contest to Disorderly Conduct. Had been diagnosed as paranoid schizophrenic and was mixing his prescription medicine with alcohol consumption. Sentenced to six months in jail suspended for on year to stay out of trouble. Given three days credit for time served. Also given a $300 fine. Ordered to stay on his prescribed medication and under psychiatric treatment. Also ordered to stay away from alcohol and subject to random alcohol testing. Set status check for 9/5/2012.
Defendant: Eugene Chow- Charges: Possession of Controlled Substance. Defendant was found with less than 1 oz of marijuana. Claimed to be allowed under the state’s medical marijuana act. But did not actually have the medically allowed marijuana card on his person at the time of the citation. Defendant said that he had applied for the card but had not yet received it. Plead guilty to disorderly conduct. Sentenced to $305 fine. Status check set for 10/3/2012.
Defendant: Dustin Lang- Charges: Possession of Hypodermic Device. Defendant already in District Court drug program and subject to random drug testing there. Sentenced to 50 hours community service. Also 90 day jail sentence suspended for 1 year if stay out of trouble. Status check set for 9/5/12.
Defendant: Elaine Suggs- Charges: Possession of Controlled substance-1 oz or less of marijuana. Defendant had applied for medical marijuana permit card but not until after initial citation. Plead guilty to charge. Sentenced with $305 fine or 30.5 hours of community service. Set for status check on 10/3/2012.
Defendant: Randall Russell- Charges: Possession of Drug Paraphernalia. Defendant had been sentenced to jail sentence suspended if he leaves the community for a period of three years. Defendant said he planned to leave in the next couple of weeks. He was told he must be out of the community by 5 p.m. on July 20. If found in the community after that, would be subject to jail time.
Defendant: Martin Barber-Charges: DUI Felony. Defendant had recently been released from 4 month inpatient program. A 6 month jail sentence is being held in abeyance while he fulfills all the terms of his previous sentence. Then the judge had learned that the defendant had been purchasing alcohol. Defendant denied drinking any alcohol. Judge ordered a breath alcohol test immediately. The matter was trailed while test was performed. The test came back clean. Judge required defendant to attend 10 months of Alcoholics Anonymous meetings each week. Also subject to alcohol testing. Continued to status check 9/5/2012.
Defendant: Raphanelda Levi- Charges: Petit Larceny – Status check. Defendant not present for status check. Had been ordered to pay fines and restitution to Lin’s Market. Lin’s had waived her paying the restitution. But the $250 fine was not paid and due. A bench warrant was ordered.
