Moapa Valley Justice Court Report (May 20, 2015)

Criminal court was held on Wednesday, May 13, 2015 with Judge Lanny Waite presiding.

Defendant: Justin Lewis– Did not appear in court but was represented by attorney. Had previous charges from 2012 but had not fulfilled all of the court requirements. Judge had previously issued arrest warrant. In the meantime, defendant had been arrested on child abuse charges. Counsel wanted to begin taking care of the various charges and asked that arrest warrant be quashed and that a hearing date be set. Judge did so and hearing was set for 6/10/15.

Defendant: Tyler Cloud– Charges: DUI. Court date set for 7/8/2015.

Defendant: Zoe Moore– Charges: Possession of Controlled Substance, Marijuana; Possession of Drug Paraphernalia; additional traffic citations. Appeared in custody. State declined the charges. Judge explained that defendant had earlier been released from custody on own recognizance if certain conditions were met. Defendant did not meet conditions and was subsequently arrested. Had been in custody 37 days. Waite asked why he should not keep her in custody for contempt of court.
Counsel questioned whether there was authority for additional contempt charge if original charges had been dropped. He said that defendant wanted to be released so that she could leave the community and move in with family in southern California.
Waite sentenced defendant to 6 months in jail on remaining traffic violations, held in abeyance on voluntary agreement that defendant would leave the jurisdiction for three years.
Defendant agreed to leave no later than Saturday evening, 5/16/2015. Case left open for a period of three years to fulfill conditions.

Defendant: Donald Brown. Charges: Battery/strangulation. Appeared in custody. Judge appointed Public Defender who asked that defendant be released on own recognizance. Judge agreed to release on bail. Matter set for 6/10/2015.

Defendant: Juan Leon– Charges: Possession of Controlled Substance, Marijuana; Possession of Drug Paraphernalia. Additional traffic violations Appeared in custody. Judge amended marijuana charge to Possession of Dangerous Drug and sentenced to six months in jail, held in abeyance with the voluntary agreement to leave the jurisdiction for three years. Drug Paraphernalia charges dismissed. On traffic violations, sentenced to four days in jail to conclude on 5/17/2015. Then defendant had until 5/20/2015 to leave jurisdiction. Defendant agreed. Case held open for three years.

Defendant: Tracey Cook– Charges: Burglary; Possession of Stolen Property. Appeared in custody. Released on own recognizance with condition to stay out of trouble. Public defender recused himself in the case. New defense counsel appointed. Set on the calendar for 6/10/15.

Defendant: Carl Roberts– Charges: 2 counts Burglary. Appeared in custody. Released on own recognizance with condition to stay out of trouble. Public defender recused himself in the case. New defense counsel appointed. Set on the calendar for 7/8/15.

Defendant: Chelsea Scarlott– Charges: DUI. State requested 90 days to file charges. Matter continued.

Defendant: Susan Harrison– Charges: Contributory Neglect. State not proceeding with the case. Case dismissed.

Defendant: Danny Nusbaum– Charges: Domestic Battery. State not proceeding with case. Case dismissed.

Defendant: Jarett Gentry Charges: DUI Alcohol In previous case, court had held 30 days jail time in abeyance if defendant stayed out of trouble. But had since been charged with DUI in Mesquite.
Judge asked why he should not impose 30 day sentence. Defendant stated that he was starting a new job in Idaho the following week. He would lose the job if serving in jail.
Judge imposed jail sentence and took defendant into custody. But he allowed for defendant’s release on Saturday night (5/16/2015) to travel to Idaho and start his job. Status check date was set for 8/5/2015. At that time, Judge wanted to have information about any vacation time that the defendant could expect to accrue from new job. The court would then impose the 30 days jail sentence here and there as possible, during the defendant’s vacation days away from work.

Defendant: Taylor VanVliet– Charges: Domestic Battery. Terms and conditions had been set in earlier proceedings but defendant did not appear at status check in April. Bench warrant was issued, and later recalled with assurance that defendant would be appear on the current court calendar.
Defendant admitted to not completing requirements given by the court. Judge sentenced defendant to 25 days in jail plus the 26 days that were being held in abeyance in earlier appearance.
All jail time was held in abeyance with agreement to stay out of jurisdiction for three years. Defendant agreed to voluntarily leave the jurisdiction no later than 5/20/15. Case open for three years.

Defendant: Billy Clifton– Charges: Battery/Domestic Violence. Status check. Had completed most of the requirements. Still needed completion of counseling requirements. Matter continued to 6/10/15 for status check.

Defendant: Anthony Sedgwick– Charges: Assault, Disorderly Conduct. Status check. Counseling requirement finished. Still fines due. Continued to 6/10/15 to finish paying fine.

Defendant: Carol Kendrick Status check. All conditions met. Case closed.

Defendant: Troy Tobbiasson– Status check. All conditions met. Final status check set for 12/9/15.

Defendant: Martin Barber– Status check. Fines not yet paid. Judge continued to 7/8/2015 by which time must be paid.

Defendant: Steven Cantrell– Charges: DUI. Scheduled for trial. But Assistant DA said that State Trooper not available to testify. Made motion to continue which was granted. Case continued to 7/8/2015
