Moapa Valley Justice Court Report (October 11, 2017)

Criminal court was held on Wednesday, September 27, 2017 with Judge Lanny Waite presiding.

Robert Samuel Lawrence – Charges: Lewdness with Child Under Age 14. Defendant appeared in custody. Case was from 2010 when Defendant was released on bail and did not return. A warrant was issued. Defendant now resides in another state from where he was arrested and extradited. Defense requested release so that he could return to work. Given the nature of the charges and history of the case, the Judge was not comfortable with releasing on bail. The matter was set for Preliminary Hearing on 10/11/2017.

William Myers – Charges: Coercion with Physical Force; Abuse of Older Person; Isolating Older Person; Domestic Battery. Defendant appeared in custody. Public defender appointed to represent. Preliminary hearing set for 10/11/2017.

Michael Martin – Charges: Battery/Domestic Violence. Arrested on a warrant for not appearing in court in August. Also had warrants outstanding in Moapa Court. Judge made arrangement with Moapa court to have both matters handled in Moapa Valley court. Defendant entered No Contest plea to the charges. Received 6 months in jail with 2 days credit for time served. The rest held in abeyance for one year to stay out of trouble. Also 48 hours community service, $350 in fines, six months of weekly Battery/Domestic Violence counseling. Matter continued to 11/22 for status check.

Brigitte Berousek – Charges: Battery/Domestic Violence. Defendant appeared in custody and had spent 30 days in jail. Judge released defendant on own recognizance. Gave credit for time served on community service requirements and fines/assessments due. Still required to complete six months of weekly Battery/Domestic Violence counseling. Continued to 11/22/2017 for status check.

Cassandra Crabtree – Charges: False information to a police officer. Defendant appeared in custody. Had been cited for the charge in October 2016 but failed to show up to court date in November. Warrant was issued and Defendant was arrested on 9/5/2017 and held in Contempt of Court. State was seeking no additional jail time. Defendant pled No Contest to the original charge. Judge released Defendant on own recognizance and gave $250 in fines and fees. Also ordered Defendant to stay out of trouble for one year or face additional Contempt of Court charges. Matter continued to 10/25/2017.

Juan Torres – Charges: Petit Larceny. Defendant appeared in custody. Had received citation on charge in May 2017 but did not show up for court date in July. Warrant was issued and Defendant was arrested on 8/28/2017. Defendant pled guilty to charge. Received credit for time served in leiu of fines and fees. Ordered to stay out of trouble for one year. Status check set for 9/26/2018.

Christopher Kelly – Charges: Obstructing a Police Officer. Defendant appeared in custody where he had been since 9/7/2017. Entered No Contest plea on the charge. Received $250 fine and order to stay out of trouble for 1 year. Released from custody and continued to 10/25/2017.

Danny Nusbaum – Charges: Battery Domestic. Defendant appeared in custody. Was arrested on the new charge on 9/24/2017. Defendant also facing trial on DUI charge in the next month.
Defense asked for release from custody. State asked that Defendant be remanded to custody based on violation of stay out of trouble order from previous matter.
Under the circumstance, Judge ruled to remand into custody. Appointed contract attorney to represent. Set the matter for 10/11/2017.
Separate DUI matter set for status check on 10/25/2017.

Eddie Bow – Charges: Trespassing; Possession of Controlled Substance, Methamphetamine. Defendant appeared in custody. Was serving a jail sentence for a separate matter from Las Vegas court. Public Defender appointed to represent. Defendant pled to amended charge of Misdemeanor Possession of Dangerous Drugs. Trespass charge dismissed. Received 90 days in jail to run concurrent to current jail sentence.

Darryl Ohte – Charges: Felony Possession of Controlled Substance; Possession of Narcotics Paraphernalia. Defendant not present in court. Warrant issued on first charge. State not proceeding with second charge.

Jon Tom – Charges: Possession of Drug Paraphernalia. Defendant not present in court. Arrest warrant issued.

T. Lee Perkins – Charges: DUI 2nd. Defendant pled guilty to the charge asking for sentencing to be in line with DUI 1st offense cases.
Judge said that he rarely ever varies from DUI 2nd sentencing which includes significant jail time and an in-bed recovery program. But in this case he acknowledged the Defendant’s continued course of action in recovery over the past six months. Sentenced to 6 months in jail held in abeyance for one year to stay out of trouble. Two days required to serve in custody, but given credit for time served. Required to continue attendance at weekly AA meetings. $700 in fines and assessments. Status check set for 11/22/2017.

Daniel Torres – Charges: DUI 1st. Defendant not present in court. Warrant issued.

Sabrina Coy – Charges: Petit Larceny. Already sentenced as part of negotiations in another case. Case dismissed.

Jody Perkins – Charges: Petit Larceny. Originally charged in May 2016. Community service was ordered. Paperwork turned in for completion of community service was alleged to be falsified with forged signatures. Judge pointed out that this was not an isolated case; two or three other Defendants had submitted similarly falsified paperwork and had served jail time.
Defendant was taken into custody, but protested that he had completed the Community Service.
Judge trailed the matter to call the authorized party who was alleged to have signed the community service document. During the phone call, that person reportedly confirmed that he had not signed the document and that no community service had been done.
Defendant ordered to turn himself in to the Clark County Detention Center on the following Friday at noon. Would be held there for thirty days sentence imposed for not staying out of trouble in the matter. Set for Status Check on 10/11/2017.

Brock Williams – Charges: Battery/Domestic Violence. Defendant pled No Contest to the charge. Sentenced to 92 days in jail with two days credited for time served. The remaining 90 days held in abeyance for 1 year to stay out of trouble. Also required to complete 48 hours of community service, weekly counseling for 6 months, and $350 in fines/fees. Status Check set for 11/22/2017.

Ronald Williams – Status Check on Charges: Possession of Stolen Property. All conditions met. Final status check set for 5/19/2018 to stay out of trouble.

Jesus Ramos, Jr. – Status Check on charges: Battery/Domestic Violence. Verification sent that Defendant was enrolled in required counseling. Set for Status Check on 10/25/2017.

Samual Perkins – Status check on Charges: Battery/Domestic Violence. All conditions met. Case closed.

Serafin Garcia – Status check on Charges: DUI. All conditions met. Case closed.

Jarom Chalfant – Status check on Charges: Petit Larceny amended to Theft; Trespassing. Had not paid restitution or done community service. Only attended 12 step program 3 times. Judge continued matter to 10/25/2017 for status check. Warned that community service must be complete by that time and restitution paid by that time.

Joshua Hammons – Status check on Charges: Battery/Domestic Violence; Violation of condition of release. Fines and fees paid. About half of community service requirement completed. Defendant had started Battery/Domestic Violence classes and begun the court ordered psychological evaluation. Continued to 10/25/2017 for status check.

Carl Tomlinson – Status check on  Charges: Possession of Controlled Substance. Defendant had completed a portion of Community Service requirement. Psychological evaluation still needed. Also remnded that he was ordered to remain alcohol and drug free and submit to random drug testing. Status check set for 10/25/2017.

Amenda Dwelley – Status check on Charges: Battery/Domestic Violence. Because of a miscommunication, Defendant had not been present for September court date and warrant was issued. Warrant was quashed. Matter was set for trial on 10/25/2017.
