Police warn OHVers of trespassing laws

The LVMPD Northeast Resident substation in Overton has issued a reminder and warning to all recreational off-roaders.

In a social media post, the police stated they have been “receiving complaints of off-highway vehicles driving through private property” in Moapa Valley and the jurisdiction area. “Not only is this inconsiderate, it is illegal,” the post said.

The complaints are coming from people who have residential properties that are not open fields or desert areas. There is even posted “No Trespassing” signage present.

The Clark County code in reference to these crimes is as follows:

14.58.010 – Prohibition of off-road use of motor vehicles.

“No person shall drive or operate any motor vehicle upon lands belonging to or occupied by another, except as hereinafter provided, without having in his immediate possession written permission therefor from the legal owner, his agent, or lawful occupant of the real property and the written permission must be exhibited to a police officer upon request or it will be presumed that the authorization does not exist and that the person is in violation of this chapter.”

Reminders were given that all other rules and codes must be followed, including age of drivers, protective wear, speed limits and more. The LVMPD will ticket anyone found in violation of the above codes and rules. In some circumstances, the OHV may be confiscated.
