Moapa Valley Justice Court Report (July 5, 2017)

Criminal court was held on Wednesday, June 7, 2017 with Judge Lanny Waite presiding.

Steven Pecsi – Status Check on Charges: DUI. All conditions met. Case closed.

Buster Winkler – Status check on charges: Engage in contractor business without valid license. Defendant owes over $4800 in fees and restitution. Had only been paying $100 per month. Deputy DA said this was not nearly enough. Defense attorney said it was all the Defendant was able to afford. Judge said that the payment schedule would not be sufficient; that customarily he requires payment within three months. Set for status check on 7/5/2017 to make a determination on whether the amount paid by then is a realistic figure.

Alex Perez – Charges: Driving without a valid license; Basic Speeding violation. Only Defense attorney in attendance. Defendant working on getting a drivers license to present to the court. Matter continued to 7/5/2017 when Defendant would need to be present in court.

Patrick Dunning – Status Check on Charges: Battery Domestic Violence. All requirements met. Set for final status check on 9/27/2017.

Anthony Soza – Charges: 2 counts of Sexual Assault against a Child Under 16; Battery with intent to Commit Sexual Assault; Lewdness with a Child Under The Age Of 16. Defendant appeared in custody. Judge recused himself for conflict of interest. Sent the matter to Judge Kolhoss in Moapa Justice Court where it appeared later that afternoon. Defendant entered Not Guilty plea. Attorney made verbal request for reasonable bail. Verbal request was denied. Defendant to remain in custody. Set for status check for negotiations on 7/19/2017.

Tyler Nuttal – Charges: Misdemeanor Possession of Hypodermic device. State not proceeding. Case dismissed.

Dennis Horne – Charges: Status check on multiple charges including Burglary, Possession of Stolen Property, Possession of Controlled Substances etc. Defendant not present because he was in state prison on charges arising in Las Vegas. It had been assumed that Defendant had been in custody since last Fall. But a new criminal complaint had come up from Feb. 2017 of Burglary and Petit Larceny. Defendant had apparently been released on own recognizance at that time. Justice issued order to transport Defendant to court from prison on 7/5/2017 for a hearing in the matter.

Leroy Seckinger – Charges: Burglary; 3 counts Grand Larceny of Firearm. Defendant appeared in custody. Contract defense counsel appointed. Set for hearing on 6/21/2017. At that hearing the matter was bound over to the 8th District Court Dept. 22.

James Ryan Hawkins – Charges: Destruction of Private Property: Placing Graffiti; Unlawful Possession of Drug Paraphernalia. Defendant appeared in custody. Public defender appointed. The alleged offense had occurred ten years ago and Defendant was being held on a warrant issued in the matter on 9/28/2007. Defendant plead to the count of Destruction of Private Property. Released from custody and ordered to pay $300 in restitution to Overton McDonalds. Also $500 in fines and assessments. Sentenced to 6 months in jail suspended for one year to stay out of trouble. Continued to 8/2/2017 for status check.

Joshua Hammons – Charges: Battery/Domestic Violence; Violation of Protective Order. Defendant had been ordered to have no contact with spouse and to not return to the premises of the residence until the matter had been resolved. He had violated that order and been taken into custody. Then released on own recognizance with repeated instructions to abide the still-standing protective order. But he had violated the order again.
Defendant initially refused legal representation stating an intention to represent himself. He said that he was optimistic that charges would be dismissed. Judge told him there was zero chance that charges would be dismissed in the case, even if the alleged victim withdrew her complaint.
Defendant agreed to seek legal counsel. But judge stated that he had no confidence that Defendant would abide by the protective order. Judge ordered Defendant to be taken into custody for Contempt of Court; to be held for four days in Jail; then to be released with the understanding to have no contact with spouse. Matter continued to 7/5/2017.

Michelle Price – Charges: Failure by Convicted Person To Register Address Change With Local Law Enforcement. State not proceeding. Case dismissed.

Jaime Jimenez-Magana – Charges: Battery/Domestic Violence. State still working through immigration status of Defendant. Asked for 30 day continuance.

Deanna Hudson – Charges: Battery/Domestic Violence. Defendant plead no contest to the charge. Sentenced to 30 days in jail suspended one year to stay out of trouble. Also given requirement to complete battery/domestic violence counseling. Ordered to have no contact with victim in the case. Matter continued to 8/2/2017 for status check.

Marissa Whited – Charges: Battery/Domestic Violence. Defendent not present in court. No contact had been made. Warrant issued.

Sabrina Coy – Charges: Petit Larceny. The charge had been packaged with another case at the District Court level where Defendant would plead guilty. It would then be set for sentencing. This matter would be dismissed upon sentencing in that case.

Whitley White – Status Check on Charges: Petit Larceny. Nothing had been done on court ordered conditions. No communication from Defendant. Warrant issued.

Carl Tomlinson – Status Check on Charges: Possession of Controlled Substance. Ten hours of community service had been completed. The rest was expected to be done within the next few days. Substance abuse evaluation had not been completed. Matter set for status check 7/5/2017 for completion of these items.

Nicholas Stevens – Status check on Charge: Battery/Domestic Violence. Defendant had continued to meet all of his requirements. Set for Status check on 8/2/2017.

Richard Santana – Status check on Charge: Trespassing. Defendant not present in court. Not all requirements had been met. Warrant issued.

Jesus Ramos Jr. – Status check on Charge: Battery/Domestic Violence. Defendant’s spouse was in attendance at court to represent. Defendant had placed himself into substance abuse rehabilitation facility in Baja Mexico. Judge said that he would need proof of Defendant’s whereabouts. Spouse promised to provide that documentation. Matter was continued to 7/5/2017.

Samual Perkins – Status Report on Charges: Domestic Battery 2nd. All requirements met. Continued to 9/27/2017 for final status check.

Robert Southall – Status Report on Charge: Domestic Battery. All requirements complete. Case closed.

Jeremy Comparoni – Status check on charge: Assault with use of deadly weapon. Defendant had not completed drug evaluation or substance abuse counseling, but had set up first appointment to be done within the next week. Matter continued to 7/5/2017 for status check.
