Moapa Valley Justice Court Report (August 23, 2017)

Criminal court was held on Wednesday, August 2, 2017 with Judge Lanny Waite presiding.

Newly Tolf – Status Check on Carges: Battery/Domestic Violence amended to Disorderly Conduct. Given credit for time served. Case closed.

Nicholas Jackson – Status Check on Charges: DUI. Defendant not present but represented by attorney. Defendant currently resides in Arizona. He had nearly completed all conditions but then had picked up another DUI charge on 3/21/2017. Matter continued to 8/30/2017 when Defendant would need to be present to address new charges.

Todd Kelson – Status Check on Charges: DUI. Defendant had completed requirements. However Judge expressed concern about him being involved in a separate incident involving being found with a minor in possession of a bong of marijuana. Defense pointed out that no citation had been issued in that incident. But the Judge stated that the condition was to stay out of trouble and this incident had come close to the line. No further action was taken against the defendant. The Judge closed the case, admonishing the Defendant to stay out of trouble.

Jaime Jimenez-Magana – Charges: Battery Domestic Violence. Defendant not present in court. No contact had been made. Bench warrant issued.

Joshua Hammons – Charges: 2 counts Battery/Domestic Violence, Violation of Temporary Protective Order, Violations of terms of OR release. Defendant appeared with attorney who had just been retained the day before.
Deputy DA expressed concerns that the Defendant had reportedly contacted a witness in the case and encouraged her to not appear in court to testify in the matter. A motion was made to remanded the Defendant into custody until the trial was complete.
Judge agreed that the Defendand had exhibited an inclination to manipulate and a disregard for the rule of law throughout the proceedings of the case. He expressed concern that, with these most recent events, the Defendant was a threat to the community and ordered that he be taken into custody for the remainder of the trial.
Later, the Defendant’s attorney came back with a plea agreement. Defendant plead to charges of Domestic Violence and Violation of Condition of OR release. TPO violation was dismissed.
Defendant given two consecutive 90 day jail sentences, suspended to stay out of trouble for one year. Required to complete domestic violence counseling 1 1/2 hours per week for six months. Also required was 48 hours of community service and $535 in fines and assessments. Finally, the judge ordered a psychological evaluation of the Defendant by a licensed professional to address the problem of an “almost chronic manipulation of others.”
Defendant released from custody and the matter was set for status check on 9/27/2017.

Danielle Gifford – Charges: DUI. Defendant appeared in custody. No criminal complaint yet filed by the state. Had reportedly been driving 100 mph in a residential area with two young children in the car. Judge expressed concern about the children’s well-being. Judge released Defendant on own recognizance with the condition that there be no drug or alcohol use of any kind.

Monique Jimenez Magana – Charges: Leaving Child Unattended in Vehicle. Defendant appeared in custody. Is also facing separate felony charges in district court. Plead no contest to the current charge and given credit for time served, pursuant to negotiations in district court.

Rachel Paren t- Charges: Resisting Public Officer. Defendant had been in custody since 7/21/2017. Had a string of charges pending in both Moapa Valley and Moapa courts, and warrants issued, with multiple conditions which had not been met.
Current charge stemmed from an incident on 4/24/2017.
Defendant stated that she had recently been turning her life around. She was living with parents where conditions had allegedly improved and had gotten a job. Then she was arrested on the warrant.
Defendant also disclosed that she was pregnant with a due date in January 2018. Defense attorney requested Defendant to be released.
Judge pointed out that the Defendant appeared to be a meth addict. As such, the Judge had very little hope that the Defendant would stay clean as long as she stayed living in the community.
Judge imposed the five months remaining on existing jail sentence. When that time is completed, the case will be closed. Judge admonished Defendant to take the time in custody to consider where to go and what to do in the future and encouraged that those plans involve a move away from the community.

Dustin Hardin – Charges: Lewdness with a Child under 18, Statutory Seduction. Defendant appeared in custody and waived preliminary hearing. Matter was bound over to 8th District Court.

Brigitte Berovsek – Charges: Battery/Domestic Violence. Defendant appeared in custody on a separate felony matter. Defendant pled to the current charge and was sentenced to 90 days in jail, suspended to stay out of trouble for one year. Also 48 hours Community Service, weekly Battery/Domestic Violence counseling for six months. Released from custody for this matter and continued for status check on 10/25/2017.

Michael Tognani – Charges: 2 counts of Burglary. Defendant appeared in custody. Waived preliminary hearing and bound over to the 8th District Court.

Aaron Clark – Charges: DUI, Permit Unauthorized Minor to Drive, Fail to properly maintain travel lane. Defendant appeared in custody. No official charges yet filed. Deputy DA asked for an additional 30 days. Matter continued to 9/27/2017.

Damien Musgrove – Charges: 2 counts of Placing Graffiti, 1 count Malicious Destruction of Property. Public Defender appointed. Set for status check on 8/30/2017.

Taylor VanVlie t- Charges: Violation of Condition of OR Release. Driver evade, elude or fail to stop on signal of peace officer; reckless Driving; 2 counts of Failure to Drive on Roadway; 3 counts of Failure to signal; Disobeying Stop Sign. Defendant appeared in custody. Back in 2014 he had agreed to stay out of the jurisdiction for a period of three years as a condition of a plea deal. Then he was arrested on 7/5/2017 in Logandale on the current charges, after allegedly leading police through a chase through a Logandale neighborhood. It was also found that he had violated the agreement on numerous occasions in the past.
Prosecution stated that they would not be proceeding with prosecution on the charges of evading police or any of the traffic charges.
Judge imposed a 25 day jail sentence on the charge of violating conditions of an OR release. After that time is served, case will be closed.

Rick Jimenez – Charges: Attempted Kidnapping 2nd degree; Grand Larceny of Auto, Larceny of Personal Property greater than $3500. Matter continued to 8/30/2017.

Jarom Chalfant – Charges: Trespassing; Status check on Petit Larceny; Theft. On Trespass charge, Defendant plead to amended misdemeanor Petit Larceny charge. Received 6 month jail sentence held in abeyance for one year to stay out of trouble; also 50 hours of Community Service.
On status check for Petit Larceny and Theft charges, nothing had been done to satisfy the conditions. Judge imposed additional 25 days for contempt of court, held in abeyance for one year to stay out of trouble.
Defendant asked that the Judge order him to attend 12 step program as a condition. Judge obliged. Also admonished Defendant to stay out of trouble or maximum jail time would be imposed. Set for status check on 9/27/2017

Danny Nusbaum – Charges: DUI 2nd. Matter continued to 8/30/2017.

Carl Tomlinson – Status Check on Charges: Possession of Controlled Substance. Defendant was working on conditions. Matter continued to 8/30/2017.

James Hawkins – Status check on Charges: Malicious Destruction of Private Property; Placing Graffiti; Possession of Drug Paraphernalia. Defendant made payment of restitution. Still needed time to pay fines. Matter continued to 9/27/2017.

Gary Rodriguez – Status Check on charges: Illegal Parking. Defendant had never paid the fine for the citation. Not present in court. Warrant was issued.

Donavan Garnes – Status check on charges: Trespassing. Defendant not present. No fines had been paid. Warrant was issued.

Deanna Hudson – Charges: Battery/Domestic Violence. Defendant not present but had signed up for Domestic Violence counseling and had completed a number of classes. Continued to 10/25/2017 for status check.

Nicholas Stevens – Charges: Battery/Domestic Violence. All terms met. Case closed.

Jordan Payne – Status check on Charges: Possession of 1 oz or less Marijuana; Possession of Drug Paraphernalia; Speeding Violation; Driving with No Proof oif Insurance. All conditions met. Case closed.
