Moapa Valley Justice Court Report (September 27, 2017)

Criminal court was held on Wednesday, August 30, 2017 with Judge Lanny Waite presiding.

Scott Kitzman – Charges: Felony Sex Offender Failure to Register. Defendant, who resides in Lincoln County, pled to amended misdemeanor charge of Providing False Information to Police Officer. Received $1000 in fines and assessments, 6 month jail sentence suspended for one year to stay out of trouble. Final status check set for 8/29/2017.

Danissa Wheeler – Charges: Possession of Drug Paraphernalia. Defendant appeared in custody on bench warrant for not appearing in court on the charge. Had entered a plea in January 2016 but did not appear again for status checks. Had not completed conditions.
Public Defender explained that Defendant was facing an ongoing child custody case and is scheduled to enter a recovery program to get back on the right track. Judge ordered release from custody on condition of entering the program, completing the 30 hours community service imposed earlier and remaining alcohol/drug free. Credited 30 days on to current six month jail sentence for time served. The other 150 days held in abeyance to complete conditions. Status check set for 10/25/2017.

Kari Jacobson – Charges: DUI. Defendant pled no contest to the charge. The incident had occurred on 1/18/2017 where she was tested at .15 blood alcohol level. Received 4 days to be spent in jail over two weekends. Also $900 in fines, 96 hours of community service, DUI school required and Victim Impact Panel must be completed. Remaining 6 month jail sentence to be held in abeyance one year to stay out of trouble. Case continued to 10/25/2017 for status check.

Michelle Davis – Charges: Trespassing. Defendant appeared in custody. State had indicated that it would not be seeking jail time for the offense. Defendant had been arrested on 8/23/2017 on original charges of Burglary, but charges had been downgraded to Trespassing. Judge insisted that if the Defendant was found guilty or entered a guilty plea, the circumstances might be a cause for a jail sentence. Thus the Public Defender was appointed to represent Defendant.
Defendant pled No Contest to Trespass charge. Judge expressed concern that Defendant had ongoing problem with addiction to alcohol which had caused “numerous brushes with the law.” Advised her to join AA program or seek other treatment. Sentenced to 50 hours community service. Released from custody but given a six month suspended jail sentence to stay out of trouble for one year. Status check set for 10/25/2017.

Brigitte Berovsek – Charges: Battery/Domestic Violence. Defendant was not present, but was in custody in the psychological ward at the CC Detention Center and unable to be transported. A warrant had been issued to take Defendant into custody because of questions about mental state. To avoid keeping Defendant in custody inappropriately, a video conferenced hearing had been scheduled for the Laughlin court the following day. This would determine if Defendant would be able to be released. A status check was set for 9/22/2017.

T. Lee Perkins – Status check on Charges: DUI 2nd. Defendant asked for an early status check on this item. He had recently been employed at a job which required him to drive. Defendant was thus asking for his driver’s license to be restored to him. The license had been siezed by the judge after the current charge.
Judge admitted not being entirely comfortable with the idea, but also didn’t want Defendant to lose the job. He noted that the Defendant had been getting help for alcohol addiction and admonished him to continue that path. He then released the license back to the Defendant.

Damien Musgrove – Charges: Two counts of Placing Graffiti; one count of Destruction of Private Property. Defendant pled to two misdemeanor counts of Malicious Destruction of Property. The third count was dismissed.
Defendant said that he did not remember what happened on the night of the incident. He said he was heavily intoxicated at the time.
Defendant given a 90 day jail sentence on each count to run consecutively; all held in abeyance to stay out of trouble for one year and remain drug and alcohol free. Also required to pay a total of $1,850 in restitution: $1,250 to private homeowner affected and $600 to Clark County Parks and Recreation. Also sentenced to complete 150 hours of community service, 15 of which must be done cleaning graffiti somewhere in the local communities if possible. Matter set for status check on 10/25/2017.

Billy Howard – Charges: Battery/Domestic Violence; Petit Larceny. Defendant failed to appear in court. Warrants issued.

Michael Pace – Charges: Possession of Drug Paraphernalia. State not proceeding with the case. Case dismissed.

Rick Jimenez – Charges: Attempted Kidnapping 2nd degree; Grand Larceny of Auto; Larceny from Person. Matter continued to 9/27/2017.

Nicholas Jackson – Status check on Charges: DUI. Defendant not in attendance. Had since picked up a new DUI charge in Henderson. Had no communication with attorney. Defense attorney, who was in attendance, asked to be released from representing Defendant. Warrant was issued.

Brock Williams – Charges: Battery/Domestic Violence. Matter continued to 9/27/2017 for trial.

Amanda Dwelley – Charges: Battery/Domestic Violence. Defendant did not appear in court. No contact made. Warrant issued.

Michael Martin – Charges: Battery/Domestic Violence. Defendant did not appear in court. No contact made. Warrant issued.

Danny Nusbaum – Charges: DUI. Matter set for trial on 10/25/2017.

Jennifer Carrisoza – Status Check on Charges: DUI. Final status check. Defendant had met all conditions. Reduced to Reckless Driving pursuant to negotiations. Case closed.

Jesus Ramos – Status Check on Charges: Battery/Domestic Violence. Defendant had not met conditions imposed. Had not enrolled in counseling required. Matter continued to 9/27/2017 for final chance.

Carl Tomlinson – Status Check on Charges: Possession of illegal Drug. Defendant had completed community service requirements. Status check was set for 9/27/2017 to allow time to receive the report.

Julie Nusbaum – Status check on Charges: Battery with use of Deadly Weapon. Defendant had completed all community service requirements. Case closed.
