Moapa Valley Justice Court Report (November 29, 2017)

Criminal court was held on Wednesday, November 22, 2017 with Judge Lanny Waite presiding.

Joshua Hammons – Status Check on Charges: Battery/Domestic Violence; Violation of Protective Order. Defendant had completed all community service and attended part of the required domestic violence counseling. The judge had also ordered a psychological evaluation and Defendant presented the resulting report. But the judge expressed concern that the report was not an evaluation. Rather, he said, it was merely a rehash of the facts of the case as recounted by the Defendant. The Judge explained that the purpose of the evaluation had been to try to address the Defendant’s apparent compulsion to control and manipulate every situation. He expressed concern that the Defendant had apparently done just that with the psychologist during the evaluation.
The matter was continued to 1/17/2018 by which time another report must be submitted that actually addressed the concerns expressed in ordering the evaluation.

Garlen Shaverdian – Charges: DUI Second; Injure/Tamper with Motor Vehicle. Defendant entered Not Guilty plea. Set for trail on 1/17/2018.

Michelle Davis – Charges: Burglary, multiple counts of Trespassing; Theft. Defendant appeared in custody. In a previous court appearance, she had been required to completed significant community service and stay out of trouble for one year. Then she had added new charges and was taken into custody. Due to Defendant violating the stay out of trouble order, Judge imposed the six month jail sentence that was being held in abeyance on earlier matters. All other matters were continued to 12/6/2017 for trial.

John Bradley Tom – Charges: Possession of Drug Paraphernalia. Defendant appeared in custody, arrested on a warrant on 11/17/2017. Warrant had been issued because he had not appeared for arraignment in October court date. Defendant given credit for time served and released from custody. Case was closed.

Marissa Whited – Charges: Battery/Domestic Violence. Defendant appeared in custody. Was also in custody on Burglary and Possession of Controlled Substance charges in Las Vegas court with an upcoming date. Defendant given release on own recognizance in the Battery/Domestic Violence matter contingent upon having no contact with the alleged victim in the case. Trial date set for 1/17/2018.

Robert Miller – Charges: Possession of Firearm by Prohibited Person; Possession of Firearm with Changed or altered Serial Number. Defendant appeared in custody. Had been arrested on the charge on October 9. No criminal complaint had yet been filed by the District Attorney. State asked for 45 more days. Defense made a motion for release on own recognizance. Judge granted the motion. Continued the matter to 1/17/2018 for status check.

Keith Griffin – Charges: Trespassing; Petit Larceny. Defendant pled guilty to Petit Larceny charge involving a BMX bicycle. Received 25 hours community service. Trespassing charge was dismissed. Matter continued to 12/20/2017.

Danielle Gifford – Charges: DUI First. Public defender appointed in the case. Continued for trial on 1/17/2018.

Jonathan Lara – Charges: Break, Injure or Tamper with Vehicle. Defendant appeared in custody. Public defender was appointed. Defendant released from custody with condition that he have no contact with alleged victim in the case. Trial date set for 1/17/2018.

Brigitte Berousek – Charges: 2 counts of Battery/Domestic Violence; Obstructing Police Officer; Trespass; 2 counts Petit Larceny. Defendant did not appear in court. No contact had been made. Warrants issued on all charges.

Joshua Lounsbury – Charges: Own or Possess Firearm by Prohibited Person. Defendant claimed that there was no reason for the charge as he did not fit description of “prohibited person.” No complaint had been filed by the state clarifying the reason for the charge. Matter was continued to 1/17/2018 for status check.

Arian Mitchell – Charges: Possession of Controlled Substance: Methamphetamine. Defendant not in attendance at court date. Warrant issued.

Gary Connelly – Charges: Battery/Domestic Violence. Deputy District Attorney advised that no jail time was being sought. Defendant plead Not Guilty in the case and stated he did not intend to hire an attorney. Alleged victim in case was Brigitte Berousek from previous case. Judge stated that because of history with Berousek in the court, there might be potential for the option of suspended jail time in the case. Public defender appointed. Matter set for 1/17/2018.

Holly Chow – Charges: Misuse of 911 System. Defendant admitted to having a medical episode on the date of the incident; she had not been fully medicated. State not proceeding in the case with the advice that defendant take medications as needed each day. Case dismissed.

Jasmine Leavitt – Charges: Contribute to Delinquency of a Minor. State not proceeding.Case Dismissed.

Anthony Phair – Charges: 17 violations of Animals Code. Nine counts were dismissed. For the rest, the Defendant had provided evidence that animals had been vaccinated for rabies. Remaining charges were dismissed.

Taylor VanVleit – Charges: Battery/Domestic Violence. Defendant not eligible for Public Defender. Advised to hire an attorney. Matter set for 1/17/2018 with requirement that no contact or communication be made to the alleged victim in the case.

Chance Tanner – Charges: Possession of Drug Paraphernalia. Public Defender appointed. Trial set for 1/17/2018.

Tod Roy Jones – Charges: DUI Second. Incident had taken place back in 2015. Defendant had also faced similar charges in Arizona where he was reportedly in and out of custody. He was not present in court back in 2015 because he had reportedly been in an inpatient treatment center in Arizona. Matter was set for trial 1/17/2018.

T. Lee Perkins – Status Check on Charges: DUI. Defendant had completed community service, paid fines, attended a Victim Impact Panel and had been attending AA meetings as required. Still required to complete DUI school. Matter continued to 1/17/2018 for further status check.

Brock Williams – Status Check on Charges: Battery/Domestic Violence. Defendant said that he was trying to move to Las Vegas and so had not completed any of the requirements: community service, fines nor counseling. Matter continued to 12/20/2017 to show significant completion of requirements.

Deanna Hudson – Status Check on Charges: Battery Domestic Violence. Defendant had completed most of the required counseling and made payments toward fines and fees. Matter continued to 1/17/2018.

Carl Tomlinson – Status Check on Charges: Possession of Controlled Substance: Methamphetamine. All community service completed. Had completed Drug Evaluation but some disagreement with Defendant on what was being recommended in the report. Matter continued to 12/20/2017 to clear up the misunderstanding.

Wesley Wright – Status Check on Charges: Reckless Driving. Defendant had pled to an amended charge of speeding but no contact had been made since that time to complete requirements. Warrant issued.

Christopher Kelly – Status Check on Charges: Obstructing Police Officer. All community service complete and fines paid. Final status check set for 9/26/2018.

Michael Martin – Charges: Battery Domestic Violence. Defendant had paid portion of fine but done no community service nor counseling. Matter continued to 12/20/2017 when requirements must be met.

Jesus Ramos, Jr. – Status Check on Charges: Battery Domestic Violence. Defendant had paid fines and completed 9 sessions of counseling. Continued to 1/17/2018 for status check.
